Capital Gain in Noida
— Section 55(2)(b) & Finance Act 2024
Selling an older NOIDA Authority plot, a residential
flat or an investment property can involve more than comparing the
purchase and sale prices. The acquisition date, historical
fair market value (FMV), eligible cost adjustments,
applicable capital gains provisions and seller's residential status
may all affect the computation.
A2Z Valuers provides property valuation support for relevant
Section 55(2)(b) FMV assignments, capital gain
documentation and property-specific valuation requirements in
Noida and the wider NCR.

HISTORICAL PROPERTY VALUATION
Section 55(2)(b) for
NOIDA Phase I & II Plot Allottees
For eligible properties acquired before 1 April 2001, the
fair market value as on 1 April 2001 may be relevant
to the capital gains cost calculation. The correct treatment depends
on the property's acquisition history, applicable law and supporting
valuation evidence.
⌂THE HISTORICAL FMV QUESTION
What was the property worth on 1 April 2001?
Residential plots allotted by the NOIDA Authority
during earlier development phases may have a substantial gap
between their original allotment price and their later market value.
For eligible acquisitions, a valuation exercise can help establish
a defensible 1 April 2001 FMV, supported by
relevant historical evidence.
The valuation should consider the specific sector, plot area,
location, allotment and possession history, land use, development
status, relevant comparable transactions and the evidence available
for the valuation date. An indicative range should not be treated
as a certified value without a property-specific assessment.
✓
Evidence-led valuation
Allotment letters, possession records, conveyance documents,
historical sale evidence and other relevant records can help
support the valuation assignment.
How the FMV can affect a capital gains calculation
Example only
The figures below demonstrate the arithmetic using a hypothetical
sale consideration of ₹2 crore and a hypothetical eligible
1 April 2001 FMV of ₹37 lakh. They are not a tax estimate or a
recommended valuation for any particular Noida property.
SALE CONSIDERATION₹2 crore
Assumed sale value before applicable adjustments
HYPOTHETICAL FMV₹37 lakh
Assumed 1 April 2001 value for illustration
ILLUSTRATIVE INDEXED COST₹1.3431 crore
If the applicable CII ratio is 363/100
Sale consideration₹2,00,00,000
Less: illustrative indexed cost₹1,34,31,000
Illustrative gain before other adjustments₹65,69,000
!
Important: The actual indexed cost, tax rate,
eligibility for any grandfathering relief and final tax liability
must be checked against the transfer date, acquisition records,
applicable Cost Inflation Index, seller's status and current law.
The illustrative calculation excludes other potential adjustments,
surcharge and cess.

Finance Act 2024:
Capital Gains Options for Noida Property Sellers
For many properties purchased after 1 April 2001, the historical
FMV option under Section 55(2)(b) is not the
relevant starting point. For eligible land or buildings acquired
before 23 July 2024, the applicable computation may require a
comparison of the tax under the amended rules and any available
grandfathering relief.
§
One sale, different tax computations
The right comparison depends on the property's acquisition date,
transfer date, type of seller and eligibility under the law.
Do not assume that every seller can choose between the same
methods.
AINDEXATION-BASED COMPARISON
20% with Indexation
For qualifying transfers by a resident individual or
resident HUF involving land or buildings acquired before
23 July 2024, the statutory grandfathering provision may permit
comparison with the earlier 20% rate using indexed cost.
Confirm the seller's residential status.
Verify acquisition date and eligible asset type.
Calculate the indexed cost using the applicable CII.
Compare tax liability under the relevant provisions.
Eligibility must be established
BAMENDED GENERAL RULE
12.5% without Indexation
The amended general regime provides for
12.5% long-term capital gains tax without indexation
for transfers on or after 23 July 2024, subject to the applicable
statutory provisions and exceptions.
Start with the actual eligible cost of acquisition.
Review eligible improvement and transfer expenses.
Calculate the gain under the amended rules.
Check whether a statutory comparison or exception applies.
Compare with any applicable relief
i
Important distinction: The grandfathering relief
described above is for qualifying resident individuals and resident
HUFs. It should not automatically be applied to NRI sellers.
The Finance Act 2024 rules, transfer date and individual facts
determine the correct treatment.
NOIDA-SPECIFIC VALUATION
From Established Sectors to Expressway Developments
Whether the property is in an established Noida sector, the
Sectors 61–93 belt or a development along the
Noida–Greater Noida Expressway, preserve the
purchase documents, improvement evidence and sale records.
The valuation assignment should match the actual purpose and
applicable legal requirements.
